1. Services Provided

BarEye Thailand ("we," "our," or "the Company") provides mystery shopping and quality assessment services for hospitality businesses in Thailand. Our services include:

  • Unannounced visits by trained evaluators posing as regular customers
  • Observation and documentation of customer service, staff behavior, and operational practices
  • Written reports summarizing observations and recommendations
  • Consultation on operational improvements

2. Legal Compliance

All BarEye services are conducted in compliance with Thai law. Our evaluators:

  • Act as legitimate customers making genuine purchases
  • Observe only publicly visible behavior and conditions
  • Do not engage in entrapment or provocation
  • Do not conduct illegal surveillance or recording
  • Comply with Thai privacy and data protection regulations

3. Report Usage and Limitations

Reports provided by BarEye contain subjective observations made during a specific visit. These reports:

  • Are provided for informational purposes to assist business management
  • Represent observations from a single point in time and may not reflect typical operations
  • Should not be the sole basis for employment decisions without independent verification
  • Do not constitute legal evidence of wrongdoing
  • Are confidential and intended only for the commissioning client

4. Client Responsibilities

By engaging our services, clients agree to:

  • Provide accurate information about their business and specific evaluation requirements
  • Use reports ethically and in compliance with Thai labor and privacy laws
  • Accept that employment and management decisions remain solely their responsibility
  • Maintain confidentiality of reports and not share them with unauthorized parties
  • Consult appropriate legal and HR professionals before taking significant actions based on our reports

5. Confidentiality

We maintain strict confidentiality regarding all client information, including:

  • Client identity and business details
  • Audit requests and specific concerns
  • Report contents and findings
  • Communication records

We do not share client information with third parties except as required by law or with explicit client consent. Non-Disclosure Agreements are available upon request.

6. Limitation of Liability

BarEye provides observation and reporting services only. We are not liable for:

  • Business decisions made based on our reports
  • Employment actions taken by clients
  • Financial losses or gains resulting from implementation of recommendations
  • Accuracy of observations beyond what was reasonably observable during the visit
  • Actions of third parties, including staff members observed during audits

Our maximum liability is limited to the fee paid for the specific service in question.

7. Payment Terms

Payment terms are agreed upon before services commence. Standard terms include:

  • Payment is due before or upon delivery of reports, as agreed
  • Prices are quoted in Thai Baht (THB) unless otherwise specified
  • Refunds are considered on a case-by-case basis for service quality issues
  • Package pricing and payment schedules are outlined in individual agreements

8. Dispute Resolution

Any disputes arising from these terms or our services will be resolved through:

  • Good faith negotiation between the parties
  • Mediation if negotiation is unsuccessful
  • Thai courts as a final resort, with Bangkok as the jurisdiction

9. Changes to Terms

We may update these terms periodically. Continued use of our services after changes constitutes acceptance of the updated terms. We will notify existing clients of significant changes via email.
